1. Introduction & Acceptance of Terms

These Terms and Conditions (“Terms”) govern your access to and use of the websites, web applications, and mobile applications (collectively, the “Platform”) operated by Go-Liberty Pty Ltd and its affiliated entities (“Go-Liberty,” “we,” “our,” or “us”). These Terms apply to all users, including schools, boarding institutions, clubs, and authorised representatives (“you,” “your,” or “User”).

By accessing or using the Platform, you confirm that you have the legal authority to enter into this agreement on behalf of yourself or the institution you represent. If you are entering into these Terms on behalf of an institution, you warrant that you have the necessary authorisation to bind that institution. You must be of legal age under applicable law to use this Platform unless authorised by a parent, guardian, or an institutional administrator.

The Platform provides administrative, communication, and data management services tailored for educational institutions and related entities. These services may include student monitoring, attendance tracking, reporting tools, support ticketing, and communication features.

By using the Platform, you agree to comply with and be bound by these Terms, as well as any applicable policies referenced herein, including the Go-Liberty Privacy Policy. If you do not agree with these Terms, you must not access or use the Platform.

Go-Liberty reserves the right to revise these Terms at any time. Updates will be posted on the Platform with the effective date indicated. Continued use of the Platform after the posting of updates constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically to stay informed of your rights and obligations.

2. Definitions

For the purposes of these Terms, the following terms shall have the meanings set forth below:

  • “Go-Liberty”, “we”, “our”, or “us” refers to Go-Liberty Pty Ltd and, where applicable, its affiliated entities, including Boarding School Software Pty Ltd.
  • “User”, “you”, or “your” refers to any individual or legal entity, including school administrators, staff, students, or parents, who accesses or uses the Platform, whether on behalf of themselves or an institution.
  • “Institution” means a school, boarding institution, sports club, camp, or any other educational or organisational entity that contracts with Go-Liberty to use the Platform.
  • “Platform” means all websites, web applications, mobile applications, portals, and related digital services provided by Go-Liberty.
  • “Account” refers to a user registration profile created and maintained within the Platform.
  • “Services” means the software tools and support features made available by Go-Liberty, including but not limited to student information management, communication features, attendance tracking, reporting, and administrative automation.
  • “Content” refers to any data, documents, media, or other materials uploaded, entered, transmitted, or otherwise made available by Users via the Platform, including institution records, student data, and communications.
  • “Personal Data” means any information that identifies or can be used to identify an individual, directly or indirectly, as defined under applicable data protection laws (e.g., GDPR, Australian Privacy Act).
  • “Data Controller” means the party that determines the purposes and means of processing personal data. In most cases, this is the Institution using the Platform.
  • “Data Processor” means the party that processes personal data on behalf of the Data Controller. In this case, Go-Liberty acts as a processor for institutional data.
  • “Third-Party Services” means any external services, applications, or platforms that are integrated with or linked to the Platform but are operated by parties other than Go-Liberty.

3. Eligibility & User Accounts

The Platform is designed to be used by a variety of institutions—including schools, boarding institutions, clubs, and camps—as well as their authorised personnel, students, and other relevant users. Accordingly, the Platform supports multiple account types with different access levels and permissions.

To begin using the Platform, an authorised representative of an Institution must first register and create a Main Institutional Account. This account serves as the administrative hub through which the Institution can:

  • Create, manage, and remove sub-accounts for authorised staff members
  • Set roles, access levels, and responsibilities for each User
  • Invite or allow students and their guardians to register individual accounts under the Institution’s environment.

Each User account, whether created by the Institution or self-registered with permission, operates within the scope of the Institution’s control and must comply with these Terms.

By registering or using an account, you confirm that:

  • You are either of legal age (18 years or older) or otherwise duly authorised by your Institution
  • You are acting within your official capacity if registering or managing an account on behalf of an Institution
  • All information provided during account registration is true, complete, and kept up to date
  • You will maintain the security and confidentiality of your login credentials
  • You will not share account access or impersonate others.

The Institution is responsible for managing the access rights of its users and ensuring that only properly authorised individuals are granted access to personal or sensitive data on the Platform. Go-Liberty is not liable for any misuse or unauthorised access resulting from an Institution’s failure to maintain proper account management protocols.

If you suspect unauthorised access or account compromise, please notify policy@go-liberty.com immediately.

4. Use of the Platform

4.1. General

Go-Liberty grants each authorised User a limited, non-exclusive, non-transferable, and revocable licence to access and use the Platform solely for the legitimate and authorised purposes related to the Institution’s educational, administrative, or organisational activities, in accordance with these Terms.

Users agree to use the Platform in good faith and only in a lawful, authorised, and responsible manner. Specifically, you agree not to:

  • Use the Platform in any manner that violates applicable laws or regulations, including those concerning data protection, intellectual property, and child safety;
  • Access, or attempt to access, parts of the Platform that you are not authorised to use, or data not intended for you;
  • Use the Platform for any fraudulent, malicious, or misleading purposes;
  • Interfere with or disrupt the integrity, availability, or performance of the Platform, including by introducing viruses, malware, or other harmful code;
  • Reverse engineer, decompile, or attempt to derive source code or underlying algorithms from the Platform;
  • Use automated tools (e.g., bots, crawlers, or scrapers) to access or extract information from the Platform without express permission from Go-Liberty;
  • Circumvent any security or authentication measures;
  • Misrepresent your affiliation with any person or entity, or impersonate another User or institutional representative;
  • Upload, transmit, or share any content that infringes the rights of others, is unlawful, offensive, harmful, or violates institutional policies.

Institutions are responsible for ensuring that all individuals authorised to use the Platform under their account (e.g., staff, students, contractors) comply with these Terms. Institutions must immediately disable access and notify Go-Liberty if they become aware of any unauthorised access, breach, or misuse.

Go-Liberty reserves the right to monitor usage, investigate suspected violations, and take appropriate action, which may include suspension or termination of access and reporting to relevant authorities.

he Go-Liberty Platform supports a flexible multi-user structure to accommodate various roles and responsibilities within an Institution. The core of this structure is the Institutional Account, which serves as the primary account created by an authorised representative of the Institution. This account acts as the administrative gateway for managing the Platform’s usage within the Institution.

4.2 Institutional Account

The Institutional Account holder is responsible for:

  • Setting up the Institution’s presence on the Platform
  • Defining internal access controls and role-based permissions for all associated users
  • Inviting and managing authorised personnel such as staff, administrators, and service providers
  • Overseeing compliance with these Terms and applicable legal obligations.

The Institution has the authority to create and manage sub-accounts, including:

  • Staff Accounts for administrative, teaching, or supervisory personnel
  • Student Accounts, which can be created directly by the Institution or by allowing students to self-register through a controlled invitation process
  • Guardian or Parent Accounts, where applicable, to enable involvement in student-related communications or updates.

4.3 User Responsibilities

Each User, whether an Institutional administrator, staff member, student, or guardian, agrees to:

  • Use the Platform only as authorised and for its intended purposes
  • Maintain the confidentiality and integrity of their login credentials
  • Refrain from sharing their account with others or allowing unauthorised access;
  • Comply with the internal rules and policies set by the Institution regarding use of the Platform
  • Promptly report any suspected misuse, data breach, or security vulnerability.

Go-Liberty does not oversee or control the internal structure or relationships within an Institution. The Institution assumes full responsibility for the configuration, supervision, and compliance of all users under its Institutional Account.

5. Code of Conduct

All Users of the Platform, including but not limited to institutional administrators, staff, students, and guardians, must adhere to the following obligations and conduct standards when accessing or using the Platform:

5.1 General Responsibilities

Users must:

  • Act with integrity, professionalism, and in accordance with applicable laws, institutional policies, and these Terms
  • Ensure that any information submitted or uploaded is accurate, lawful, and up to date
  • Maintain the confidentiality of their account credentials and promptly report any unauthorised access
  • Use the Platform only for its intended purposes in connection with educational, administrative, or organisational activities
  • Respect the rights, privacy, and data of other Users, including students and staff.

5.2 Prohibited Conduct

Users may not, under any circumstances:

  • Engage in unauthorised access, tampering, or circumvention of access controls
  • Use the Platform to harass, intimidate, threaten, or harm others
  • Post, transmit, or distribute content that is obscene, defamatory, discriminatory, or otherwise unlawful
  • Infringe upon the intellectual property or privacy rights of Go-Liberty or third parties
  • Misuse the Platform for commercial purposes or unrelated personal gain without written consent
  • Collect or harvest data from other users without express permission.

5.3 Institutional Responsibility

Institutions are fully responsible for ensuring that all Users operating under their Institutional Account:

  • Are properly authorised and supervised
  • Have agreed to and are aware of these Terms
  • Use the Platform in accordance with relevant laws and the Institution’s internal policies
  • Undergo appropriate onboarding, especially in contexts involving minors and sensitive data
  • Are removed or deactivated promptly when access is no longer required or appropriate.

Go-Liberty reserves the right to suspend or terminate access for any User found to be in breach of these obligations, and may report unlawful activity to the appropriate authorities.

6. Intellectual Property Rights

All intellectual property rights in and to the Platform and its underlying technology, content, and design—including but not limited to software code, text, graphics, images, logos, interfaces, databases, and documentation—are and shall remain the exclusive property of Go-Liberty Pty Ltd and/or its affiliated entities or licensors. These rights are protected under applicable copyright, trademark, and other intellectual property laws in Australia and internationally.

6.1 Platform Ownership and License

Subject to your compliance with these Terms, Go-Liberty grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for the purposes of using the Services in connection with your Institution’s educational, organisational, or administrative needs. No ownership rights are transferred to you under this license.

You may not:

  • Copy, reproduce, distribute, republish, download, display, post, or transmit any part of the Platform or its content in any form or by any means except as expressly permitted
  • Modify or create derivative works based on the Platform or its content
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use any branding, logos, or trade names of Go-Liberty without our prior written permission.

6.2 User Content

You retain all intellectual property rights to the data and content that you, your staff, or students upload or input into the Platform (“User Content”). By uploading or submitting User Content, you grant Go-Liberty a worldwide, non-exclusive, royalty-free license to use, host, store, process, and transmit such content solely for the purpose of providing and improving the Services.

You represent and warrant that you have all necessary rights, licenses, and permissions to submit the User Content and that it does not violate any third-party rights or applicable law.

6.3 Feedback

If you or any User provides feedback, suggestions, or ideas about the Platform (“Feedback”), Go-Liberty may freely use such Feedback without restriction or obligation. You acknowledge that any such Feedback is given voluntarily and does not create any confidentiality or compensation obligation on the part of Go-Liberty.

If you believe any content on the Platform infringes your intellectual property rights, please contact policy@go-liberty.com with details of the alleged infringement.

7. Data Protection & Privacy

Go-Liberty is committed to ensuring the protection, confidentiality, and responsible handling of all personal data processed through the Platform. Our practices are aligned with relevant data protection laws, including the General Data Protection Regulation (GDPR), Australian Privacy Act 1988, and other applicable international privacy regulations.

In most cases, Go-Liberty acts as a Data Processor on behalf of Institutions (who are the Data Controllers). This means we process personal data solely based on the Institution’s documented instructions and only to deliver the contracted services.

Go-Liberty may act as a Data Controller with respect to data collected via our public website (e.g., usage analytics, contact form submissions, marketing consents). In such cases, we determine the purposes and means of processing that data, and our Privacy Policy governs that processing.

8. Fees, Payment Terms & Refunds

Access to certain features of the Platform may require payment of subscription fees. Fees are determined based on the selected service package, number of users, custom features, or other factors agreed upon during the onboarding or renewal process.

Unless otherwise agreed in writing, all fees are:

  • Quoted and payable in Australian Dollars (AUD)
  • Due in advance on a recurring basis (e.g., monthly or annually)
  • Exclusive of applicable taxes, levies, or duties imposed by taxing authorities.

Institutions are responsible for providing valid and updated billing information. Failure to process payment may result in suspension or termination of access to the Platform.

Subscriptions may renew automatically unless otherwise specified in the order or agreement. We will provide reasonable notice before any changes to pricing or billing frequency take effect. Institutions may adjust user counts or service levels during the renewal cycle subject to updated pricing.

Unless required by law or expressly stated otherwise, all payments are non-refundable. No refunds or credits will be issued for partial use, downgrades, or unused periods.

If you believe you were charged in error, please contact policy@go-liberty.com within 14 days of the invoice date. Overdue balances may incur late fees or interest, and Go-Liberty reserves the right to suspend access until outstanding amounts are paid in full.

Go-Liberty may use third-party payment providers to process transactions. You may be subject to the terms and conditions of those providers. Go-Liberty is not responsible for any errors, delays, or issues caused by such third parties.

9. Termination & Suspension

9.1 Termination by Institution

An Institution may terminate its account at any time by providing written notice to Go-Liberty at policy@go-liberty.com. Upon termination, all associated Sub-accounts will be deactivated, and access to the Platform and Services will cease. Termination does not relieve the Institution of any outstanding payment obligations.

9.2 Termination or Suspension by Go-Liberty

Go-Liberty may suspend or terminate your access to the Platform, with or without notice, if:

  • You materially breach these Terms or applicable laws
  • There is a reasonable suspicion of misuse, fraud, or unauthorised access
  • Required by law, a court order, or a governmental authority
  • Continued access would pose a security, privacy, or legal risk to Go-Liberty or other users
  • Payment obligations remain unresolved after reasonable notice.

We will make reasonable efforts to notify you of the reason for suspension or termination unless prohibited by law or where doing so may compromise ongoing investigations or security.

9.3 Effect of Termination

Upon termination:

  • All rights and licences granted under these Terms will immediately cease
  • Access to the Platform and user accounts will be disabled
  • Data associated with the account will be handled in accordance with our Privacy Policy and applicable data retention and deletion policies
  • Go-Liberty is not liable for any loss of data following termination unless otherwise agreed in writing.

9.4 Data Portability & Export

Institutions may request a copy of their data within thirty (30) days of account termination. After this period, Go-Liberty may delete or anonymise the data unless retention is required for legal, regulatory, or dispute resolution purposes.

9.5 Survival

Any provisions that by their nature should survive termination (e.g., confidentiality, intellectual property, limitation of liability, indemnification) shall remain in effect even after termination.

10. Third-Party Services & Links

The Platform may include integrations or connections with third-party services, websites, or tools to support certain functionalities (e.g., payment processors, communication platforms, analytics providers, or hosting services). Go-Liberty does not own or control these third-party services and is not responsible for their content, policies, or practices.

Your use of third-party services is subject to the separate terms and privacy policies of those third parties. We encourage you to review such terms before interacting with any third-party features or tools.

The Platform may contain links to external websites or resources that are not operated or controlled by Go-Liberty. These links are provided for your convenience only. Go-Liberty makes no warranties or representations regarding the accuracy, content, or practices of third-party websites, and your access to such websites is entirely at your own risk.

Go-Liberty does not endorse, sponsor, or assume responsibility for any third-party content, products, services, or practices. The inclusion of a link or integration on the Platform does not imply endorsement or association.

Go-Liberty shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of or reliance on any third-party services or linked websites, or any dealings you may have with third-party providers. Your interactions with any third-party providers are solely between you and the applicable third party.

11. Disclaimers & No Warranties

The Platform and all related services are provided on an “as is” and “as available” basis. Go-Liberty does not guarantee that the Platform will be error-free, uninterrupted, secure, or free of viruses or other harmful components. You use the Platform at your own discretion and risk.

To the maximum extent permitted by applicable law, Go-Liberty disclaims all express, implied, or statutory warranties, including without limitation any warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that any content or information provided via the Platform is complete, accurate, or current.

Go-Liberty makes no representations or warranties regarding third-party content, services, or integrations available through or linked from the Platform. The availability of such third-party offerings does not imply endorsement or responsibility.

Institutions are solely responsible for verifying that the Platform is appropriate for their use case, that their own users are trained to use the system properly, and that their data inputs and interactions with the Platform comply with legal and institutional policies.

Go-Liberty may occasionally need to suspend access to the Platform for maintenance, upgrades, or other technical reasons. While we strive to minimise disruption, we cannot guarantee ongoing availability or uninterrupted access.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Go-Liberty and its affiliated entities shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your access to, use of, or inability to access or use the Platform.

In no event shall Go-Liberty’s total aggregate liability for all claims arising from or related to the use of the Platform exceed the total amount paid by the Institution (or on your behalf) for the Services in the six (6) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain types of damages. In such cases, Go-Liberty’s liability shall be limited to the maximum extent permitted by applicable law.

The limitations in this Section form an essential basis of the agreement between you and Go-Liberty and shall apply even if any limited remedy fails of its essential purpose.

13. Indemnification

You agree to indemnify, defend, and hold harmless Go-Liberty Pty Ltd, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees and costs) arising out of or related to:

  • Your access to or use of the Platform
  • Any violation of these Terms or applicable laws
  • Any content or data you submit, post, transmit, or store through the Platform
  • Any misuse or unauthorised use of the Platform by you or by Users acting under your Institutional Account
  • Any infringement or alleged infringement by you of any intellectual property or privacy rights of any third party.

Go-Liberty reserves the right, at its own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you. In such cases, you agree to cooperate fully with our defense.

14. Changes to the Terms

Go-Liberty reserves the right to update, revise, or otherwise modify these Terms at any time to reflect changes in our services, legal requirements, or business practices. Any changes will become effective upon posting the updated version on the Platform, unless a different date is specified.

We will indicate the effective date of the most recent version at the top of this document. Where material changes are made, we may, but are not obligated to, notify you through the Platform or by email using the contact information associated with your account.

Your continued use of the Platform after the revised Terms become effective constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically to ensure you understand your rights and responsibilities.

15. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of Queensland, Australia. Any disputes arising under or in connection with these Terms shall be resolved by the courts of Queensland, unless otherwise required by applicable law.
